April 21, 2025 – The U.S. Department of Commerce (Commerce) has announced its final determinations in the anti-dumping (AD) and countervailing duty (CVD) investigations concerning alkyl phosphate esters imported from China. The ruling confirms widespread expectations, imposing steep tariffs that will significantly impact the global flame retardant market.

Key Findings of the Final Determinations

The investigation revealed that the majority of Chinese exporters face a weighted-average dumping margin of 174.40%, with some exporters hit by an even higher rate of 256.40%. Non-listed exporters were uniformly assigned a 269.02% dumping margin. Consequently, the cash deposit rates (adjusted for subsidy offsets) will range between 135.28% and 243.09%.

Additionally, the final subsidy rates averaged 91.07%, a notable decrease from the preliminary findings. Although the official AD/CVD rates will be finalized by June 9, 2025, historical data suggests that the combined duties will increase total import costs by at least 226%.
